1. Who we are
1.1 The Mesura Health programme is operated by Vast Dynamic Ltd ("Vast Dynamic Ltd", "Mesura", "we", "us"), a limited company incorporated in Hong Kong, company registration number 77131343, registered address Level 9, Amtel Building, 144-148 Des Voeux Road Central, Hong Kong.
Mesura Health is the client-facing brand of Vast Dynamic Ltd; it is not a separate company, and your contract is with Vast Dynamic Ltd.
1.2 Mesura provides a care-orchestration service: the programme structure, WhatsApp-based communication and coordination, measurement tracking, reminders, and administrative support around your medical care. Mesura is not a clinic, does not practise medicine, and holds no pharmacy or wholesale licence.
1.3 All clinical care in the programme is provided by a partner clinic — a private medical clinic registered in Malaysia, whose registered medical practitioners conduct consultations, make every clinical decision, and issue every prescription. Medication is dispensed by that clinic's licensed in-house pharmacy. Mesura works with more than one partner clinic, and we tell you which clinic is providing your care when your consultation is booked.
1.4 Every clinical decision — whether the programme is appropriate for you, what (if anything) is prescribed, dose changes, holds, and stopping treatment — is made by your treating doctor at the partner clinic. It is not made by Mesura and it is not made by software.
2. Eligibility
2.1 To use the service you must: (a) be at least 18 years old; (b) be located in Malaysia at the time of consultation and dispensing; (c) have legal capacity to enter this agreement; and (d) be registering for your own care, not on behalf of another person.
2.2 Acceptance into any programme is always subject to clinical assessment by a partner clinic doctor, who may decline to treat you or discontinue treatment at any time on clinical grounds. Being declined is a normal outcome and is handled per the Refund Policy.
2.3 We may verify eligibility information you provide and may refuse or end service where it is materially inaccurate.
3. What the service is — and is not
3.1 The service includes: coordination of doctor consultations with the partner clinic; delivery of doctor-approved information and check-ins over WhatsApp; recording of your self-reported measurements; medication supply coordination through the partner clinic's pharmacy; and escalation of your reports to your care team.
3.2 How consultations happen. Consultations are by video, including your first, so you can take part from anywhere in Malaysia. Your doctor may require you to attend in person, or to have tests done, before prescribing or at any stage of treatment, and you may ask to be seen in person at any time. Video consultation has limits, which are explained in the Medical Consent — your doctor works from what you tell them and what can be seen on screen.
3.3 Parts of the service use software assistance, including AI, to draft messages, classify your messages for routing, and prepare summaries for your doctor. The AI never diagnoses, never prescribes, and never determines your dose; a safety layer routes medication and symptom questions to humans; and every clinical decision is made and signed by a doctor.
3.4 The service is not an emergency service. WhatsApp messages are not monitored on a guaranteed-response basis for emergencies. If you have a medical emergency, call 999 or go to the nearest emergency department immediately.
3.5 Content on our website and in our messages is general information about the programme and your care. It is not medical advice except where communicated to you by, or on the documented instruction of, your treating doctor. Using this website — including completing any online assessment — does not create a doctor-patient relationship. That relationship begins when you are seen by a doctor at the partner clinic.
3.6 Paying does not guarantee a prescription. The entry consult fee pays for assessment and doctor review, not for an outcome. If the doctor decides treatment is not appropriate for you, that is a complete and legitimate result of the service you paid for.
3.7 About the images and content on our site. Some website material may be generated or enhanced using artificial intelligence, and people shown in our imagery are models or actors, not patients — we do not publish patient photographs, which Malaysian Medical Council rules prohibit in any case. Any patient quotation appears only with that patient's consent and after review, never with a photograph and never as a before-and-after.
3.8 Medical certificates: in line with Malaysian Medical Council rules, no medical certificate will be issued on the basis of a video-only consultation.
3.9 The service is provided in English and Bahasa Malaysia. Those are the two languages the programme runs in, including the safety screening that reads every message you send.
4. Fees and billing
4.1 Three charges, paid to three different parties. We would rather you knew which is which:
- The consultation — RM50 — is charged by the partner clinic that treats you, at your appointment, under that clinic's own terms. It pays for the doctor's time. It is not monthly and it does not change with your dose.
- Your medicine is charged by the clinic's licensed pharmacy, which dispenses it. It is priced by dose, so it costs more at a higher dose. Every band is published at mesura.health/pricing before you start, including doses you have not reached.
- The care programme — RM299 to RM499 a month — is charged by Mesura. Where you sit in that range is set at your consultation and told to you before anything is charged. It does not change when your dose does.
4.2 Nothing is charged until a doctor approves treatment. Being assessed is not being sold to. If the doctor decides the programme is not right for you, no care fee is ever raised.
4.3 What the care programme covers: WhatsApp check-ins and care between visits, your doctor's review of your plan, measurement tracking, nutrition guidance, and the coordination of your prescription, dispensing and delivery. It does not include the consultation or the medicine, which are charged by the clinic and the pharmacy as set out in 4.1.
4.4 Your RM49 deposit is credited against your first programme month. It is only asked for after a doctor has read your assessment and cleared you to start — if you are not cleared, you are never asked for it. You do not pay it twice, and you do not have to claim it — if the credit does not appear on your first invoice, tell us and we will fix it.
4.5 Not included: laboratory tests ordered outside the programme; treatment for conditions outside the programme's scope; anything your doctor decides is not right for you.
4.6 How the entry consult is paid. Collected by Vast Dynamic Ltd as merchant of record, through our payment provider's secure page. Mesura never sees or stores your card details. The payment is made to Vast Dynamic Ltd in Hong Kong, so your bank may treat it as an international transaction and apply its own foreign-transaction fee — we would rather tell you that than have it surprise you. Your statement will show MESURA HEALTH.
4.7 Price changes. We will tell you before the entry consult fee changes, and a change never applies to a payment already made. Changes to the programme month are the clinic's, notified by the clinic under its terms.
4.8 If the entry consult payment fails, we will tell you, and your assessment simply waits until it is resolved. We will never interrupt care in a way your doctor considers clinically unsafe.
5. Your responsibilities
You agree to: (a) provide accurate, complete medical information during assessment and keep it updated, including pregnancy, new diagnoses, new medications and hospitalisations; (b) report side effects and adverse effects promptly through the programme channel or, where urgent, to emergency services; (c) use medication only as prescribed to you, and never share, sell, or transfer prescribed medication to any other person; (d) attend or reschedule booked consultations; (e) keep your WhatsApp account and phone secure, since it is the channel through which your care is delivered; and (f) not misuse the service, including by attempting to obtain medication through false information.
6. Suspension and termination
6.1 You may end your programme at any time, without giving a reason, by messaging us on the programme channel. Billing and refund consequences are set out in the Refund Policy.
6.2 We may suspend or end your access where: (a) your doctor determines the programme should stop on clinical grounds; (b) you materially breach these terms (including §5(c) or (f)); (c) fees remain unpaid after notice; or (d) we are required to by law or a regulator.
6.3 Continuity of care survives termination in every case. If the programme ends — for any reason, including our ceasing to operate — you will not be abandoned mid-treatment: the partner clinic will continue consultations and dispensing for enrolled patients or effect a clinically safe transfer to another registered clinic or prescriber, with a minimum 60-day transition, and refunds or pro-rating handled per the Refund Policy.
6.4 The partner clinic retains its statutory medical records regardless of termination; data handling on exit is described in the Privacy Policy.
7. Liability
7.1 Clinical care is provided by the partner clinic and its registered doctors, who are responsible for clinical acts and maintain professional indemnity cover. Mesura is responsible for its non-clinical service: the platform, messaging, coordination and data handling.
7.2 Nothing in these terms excludes or limits liability that cannot be excluded or limited under Malaysian law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights under the Consumer Protection Act 1999 (including any non-excludable guarantees) to the extent it applies.
7.3 Subject to 7.2, Mesura's aggregate liability to you arising out of the service is limited to the greater of RM10,000 or the total fees you have paid to Mesura, and Mesura is not liable for loss that is not reasonably foreseeable.
7.4 We do not guarantee any particular health outcome, weight change, or treatment result. Results differ for each person.
8. Intellectual property and feedback
The service, its content, software and branding are owned by or licensed to Mesura. You receive a personal, non-transferable right to use the service for your own care. Feedback you give us may be used to improve the service without obligation to you. Your personal data is governed by the Privacy Policy, not this section.
9. Communications
Programme communication happens primarily over WhatsApp via our business messaging providers. By enrolling you agree to receive care-related messages there. Marketing messages are separate, optional, and require your distinct consent (PDPA s.43), and consenting to them is never a condition of purchase or of care.
To stop marketing messages, reply STOP at any time on the programme channel. It takes effect immediately, we will confirm once, and it does not affect your care messages — those continue while you are enrolled, because they are part of the service you are paying for. To end your care communications, end your programme under §6.1 or withdraw your consent (reply WITHDRAW), which is a different thing and is handled per the Medical Consent §7.
Message and data rates may apply through your mobile provider, and we are not responsible for messages delayed or not delivered by your carrier or by WhatsApp.
10. Changes to these terms
We may update these terms. Material changes will be notified to you at least 30 days before they take effect, on the programme channel. Continued use after the effective date is acceptance; if you do not accept, you may end your programme under §6.1.
11. Governing law and disputes
These terms are governed by the laws of Malaysia, and disputes are subject to the non-exclusive jurisdiction of the courts of Malaysia — notwithstanding that Vast Dynamic Ltd is incorporated in Hong Kong — so that you are not required to bring a claim outside your own country. This is without prejudice to your right to complain to the Malaysian Medical Council (clinical conduct), the Personal Data Protection Commissioner (data), or the Tribunal for Consumer Claims (Tribunal Tuntutan Pengguna Malaysia) at any time.
